Introduction
Dear Customer, these Terms and Conditions regulate the method of concluding sales agreements via the aforementioned website, the rules for fulfilling these agreements including delivery, rights and obligations arising from applicable law, and the procedure for withdrawal from the agreement and filing complaints. The Terms and Conditions consist of four main sections:
a) §§1–3 contain the general regulations of these Terms and Conditions;
b) §§4–7 describe the process of purchasing Goods/Services;
c) §§8–12 contain regulations related to determining defects in Goods/Services and the right of withdrawal;
d) §§13–14 include all other regulations.
§1 Basic Definitions

Online Store – a store located at the address of this website.

Seller – the owner of the website. The Consumer purchases goods/services from the entrepreneur whose details are provided in the “Company Data” section.

Seller Address – whenever the Terms mention the Seller's address, it refers to:
a) the registered office (see “Company Data” section)
b) email address (see “Company Data” section) -
Client – a natural person with full legal capacity, and in cases provided by generally applicable law, also a natural person with limited legal capacity, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, who has entered into or intends to enter into a sales agreement.

Consumer – Article 22(1) of the Civil Code: a natural person performing a legal action with the Seller not directly related to their business or professional activity.

Sales Agreement – a contract for the sale of a Product posted on the Online Store concluded between the Client and the Seller through the Online Store.

Goods – a Product or movable item that the Client acquires via the Online Store.

Order – a declaration of will by the Client submitted via the Online Store specifying the type and quantity of Goods available at the time of the order, payment method, delivery method, place of delivery, and Client data.

Order Form – an electronic service, a form on an electronic medium available in the Online Store, enabling the submission and processing of the Order, including adding Products to an electronic cart, and specifying the terms of the Sales Agreement, including delivery and payment methods.

Order Fulfillment Time – the time within which an order placed by the Client is prepared, packaged, sealed by the Seller, and handed over for delivery via the method chosen by the Client.

Business Day – a day from Monday to Friday excluding statutory holidays.

Price Reductions – possible discounts, PROMOTIONS, and price reductions can be checked on the price chart displayed for the product. Price history is available for the last 30 days and recorded automatically in a verifiable manner.

Prices – prices of products in the e-store are fixed at a given time and are not influenced by any pricing algorithms, regardless of how the client accesses the site, browser used, gender, age, etc.

Consumer Rights Act, Act – Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended).

GDPR – Regulation (EU) 2016/679 of the European Parliament and Council (27 April 2016).
§2 General Provisions

The Seller declares compliance with all required personal data protection rules as provided by the Personal Data Protection Act (Journal of Laws of 2015, item 2135, as amended) and GDPR. The Client consents to the collection, storage, and processing of personal data by the Seller solely for purposes directly related to the fulfillment of the ordered Goods/Service. Detailed rules for data collection, processing, and protection are specified in the Online Store’s Privacy Policy.

The Seller declares that the Goods/Service comply with the agreement in terms of description, type, quantity, quality, completeness, and functionality, including compatibility, interoperability, and availability of updates for digital goods; and fitness for a specific purpose communicated by the consumer and accepted by the Seller.

The Seller declares that, in compliance with EU Regulation (transposing Directive (EU) 2019/2161), reviews published must indicate whether the reviewer used or purchased the product, and the measures ensuring their authenticity.

Reviews on our website come from actual customers who purchased and used our products. Reviews are posted after confirmation of product delivery. Reviews may also be imported from Google or Allegro. Efforts are made to ensure all reviews are genuine and accurate, and incorrect ones are removed.

By placing an order, the Client acknowledges and accepts these Terms. Acceptance is required to complete the order.

The Data Controller applies technical and organizational measures proportional to risks and the categories of protected data. Detailed protection rules are specified in the Data Protection Policy.

Data of the Administrator can be found in the “Company Data” section of the website.

Each data subject has the right to:
a) monitor and control the processing of personal data;
b) identify the data controller and their contact information;
c) receive information on purpose, scope, method, and duration of data processing;
d) receive data in an understandable form;
e) know the data source unless legally confidential;
f) request completion, update, correction, suspension, or deletion of data if incomplete, inaccurate, or unlawfully collected. -
The Client has the right to access, correct, or request deletion of their data. The data controller must act promptly unless other legal provisions apply.

By finalizing the order, the Client consents to the processing of personal data for order fulfillment. Data may be shared with third parties only when legally required or necessary for order fulfillment.

Clients may consent to receive marketing information by subscribing to the newsletter.

Clients must comply with these Terms for the purpose of fulfilling the order in accordance with applicable law and social norms.

The Seller declares that products sold comply with their description and photos. The first photo is illustrative; subsequent images show actual condition. Used products may have minor defects described in the product description. Products are safe and legally free to use.

The Seller delivers within Poland and, for Consumers in Europe, and potentially to other countries if agreed upon.

All products sold are legally introduced to the Polish market. Product information is an invitation to conclude a contract under Article 71 of the Civil Code.

Prices are in Polish zloty (PLN) and include VAT and other applicable charges.
-
Prices do not include delivery costs, which are added during checkout.

Sole proprietors purchasing outside their business may withdraw from the contract within 14 calendar days.

Consumer provisions apply to individuals contracting outside professional activity when the contract is non-professional per CEIDG.

Verification of professional activity is based on CEIDG and PKD codes.
22–25. Provisions clarify rights and limitations for sole proprietors, including abusive clauses, warranty rights, recourse claims, and withdrawal rights.
§3 Terms of Service Provision

The Online Store provides services electronically. Agreement requires filling out the online order form. Participation is voluntary.

Service agreements are concluded electronically by filling out the order form. Agreements are for a fixed time and terminate upon form submission or withdrawal.

Service is free but requires internet access.

Orders may be placed 24/7.
-
The Client must consent to data processing to submit an order. Failure to provide data equates to withdrawal.
-
Parental consent is required for minors under 16.
-
Internet access costs are borne by the Client.
§4 Terms of the Agreement

To conclude a binding Sales Agreement, the Client selects the product quantity, features, and specifications, completing the online form with necessary order details.

Orders may be submitted via:
a) online form (shopping cart)
b) email (outlet@zerowaste.design) -
Accurate Client data is required for order processing. The Store confirms receipt via email.

Account registration is voluntary and free.
-
Custom-made products require submission of specifications (text, graphics, dimensions, etc.) per product description.
-
The Seller sends an order confirmation electronically, marking contract conclusion.
-
Confirmation includes quantity, type, specification, total price (PLN), delivery costs, and discounts.
-
Multiple discounts combine only if explicitly allowed. Otherwise, one discount applies.
§5 Order Fulfillment

Orders are fulfilled in the order received. Each is a priority.
-
Fulfillment time: 1–30 business days from order submission; for “made-to-order” products, see product page. Time includes preparation, packaging, delivery, and manufacturing. Delivery time depends on chosen shipping method.

If fulfillment is delayed, the Seller contacts the Client to adjust the schedule or delivery method.
§6 Delivery

Delivery is via Poczta Polska, courier, or other mutually approved methods without excessive costs.

Delivery is to the address provided in the order or collected in person.
-
Goods are properly packaged to prevent damage.
-
Delivery costs are disclosed during order completion and depend on country, quantity, weight, and shipping method.
§7 Payment Methods

Bank transfer prepayment.
-
Online payment via credit card (Visa, MasterCard) or Przelewy24.
-
Cash on delivery via courier.
-
Sales are documented as requested by the Client.
§8 Warranty
-
Warranty-related deliveries are at the Seller’s expense.
-
Statutory limitation periods apply: 6 years generally, 3 years for periodic services or business-related claims, ending the last day of the calendar year.
-
Seller is liable for defects for 2 years from delivery. Physical defects include non-conformity with contract, missing properties, unsuitability for declared purpose, or incomplete delivery.

Presumption of non-conformity lasts 2 years.
-
Complaints must be sent electronically or by post (see §1.3 “Company Data”). A template is optional.
-
Defective goods may be sent to the Seller for assessment if feasible.
-
The Seller responds within 14 calendar days; failure equals acceptance of the complaint.
-
First complaint entitles repair or replacement; if ineffective, price reduction or withdrawal is possible.
-
The Seller covers all costs for collection, delivery, and replacement.
§9 Withdrawal
-
Consumers have the right to withdraw from distance contracts under the Consumer Rights Act, Art. 27.
-
No right of withdrawal applies to digital content delivered with prior consent.
-
Withdrawal period: 14 calendar days from receipt.
-
Withdrawal renders the contract null, and both parties return what was exchanged within 14 days.
-
Consumers may use the online form (Appendix 1) or send a written statement.
-
Timely sending preserves the withdrawal right.
-
The Seller confirms receipt and informs about the procedure.
-
Payment is refunded within 14 days using the original payment method unless otherwise agreed.
-
Refund may be delayed until product return or proof of dispatch.
-
Return within 14 days unless the Seller collects the product.
-
Consumers bear direct return costs.
-
Withdrawal is free except as specified by law.
-
Returns to Seller’s address (see §1.3 “Company Data”).
-
Liability for diminished value from excessive use rests with the Consumer.
-
Exemptions from withdrawal include fully executed services, customized goods, perishable items, sealed goods affecting health/hygiene, and inseparably combined goods.
§10 Complaint Procedure

Complaints must include Client name, address, email, subject, order number if possible, and defect description.
-
First complaints allow repair or replacement; digital goods may include service correction. Ineffective remedies allow price reduction or withdrawal.
-
Replies are due within 14 days; silence implies acceptance.
-
Failure to respond does not equate to approval for withdrawal claims.
§11 Liability
-
Client is responsible for content submitted; the Seller only provides the platform. Client confirms ownership and legal rights.

Clients must not post third-party personal data without consent or promotional content inconsistent with the store’s purpose.
-
The Seller reserves the right to modify or remove content violating the Terms or law.
§12 Out-of-Court Complaint Resolution and Claims

Information on out-of-court dispute resolution is available at consumer protection offices and online (www.uokik.gov.pl, www.federacjakonsumentow.org.pl).

Options include: mediation via Provincial Trade Inspection, permanent Consumer Court, or free legal assistance from the Consumer Federation.
-
Cross-border disputes may be assisted by European Consumer Centres (www.konsument.gov.pl).
-
Use of these procedures is voluntary and requires consent from both parties.
§13 Provisions Concerning Entrepreneurs

Applies only to Clients not acting as consumers (professional purchases).
-
Seller may withdraw within 14 days without reason; no claims arise for professional clients.
-
Service agreements may be terminated immediately with notice to the client.
-
Seller may limit payment methods and require full/partial prepayment.
-
Risk of accidental loss or damage transfers to the professional Client upon delivery to the carrier.
-
Professional Clients must inspect shipments and handle transport claims.
-
Warranty is excluded for non-consumer clients (Art. 558 §1 CC).
-
Liability is limited to paid amount, only for foreseeable damages, excluding lost profits.
-
Disputes with non-consumers fall under the jurisdiction of the Seller’s court.
§14 Final Provisions

The Online Store honors all Client rights under applicable law.
-
If consumer law provides more favorable mandatory provisions, they override these Terms.
-
All content on the website (graphics, text, layout, logos) is protected by copyright and is the Seller’s property. Unauthorized use entails civil and criminal liability.
-
The Seller, as data administrator, informs that:
● providing data is voluntary but required for order fulfillment;
● individuals have full access rights to their data.
